Buyback Terms Version: 2026-08-22-v1
Buyer Terms Version: 2026-10-18-v1
1. Agreement & Eligibility
Azarias Books is a brand of Azarias Group LLC, a New Jersey limited liability company. These Terms of Service ("Terms") are an agreement between you and Azarias Group LLC, operating as Azarias Books ("Azarias," "we," "us," or "our"). Sections 2 through 9 address books you sell to us; Section 11 addresses books you buy from us.
For a buyback transaction, the version of these Terms identified in the final checkout attestation and recorded with your order governs that transaction. Account registration or earlier acceptance of site terms does not replace the transaction-level acceptance required when you submit a buyback order.
You must be at least 18 years old and legally capable of entering this agreement to submit a buyback order.
2. Seller Representations
Each time you submit a buyback order, you represent and warrant that:
- You are at least 18 years old.
- You are the lawful owner of every item submitted and have full authority to transfer legal title to it.
- Every submitted item is free of liens, security interests, claims, and other encumbrances.
- No submitted item is stolen or unlawfully obtained.
- The information you provide in connection with the transaction, including item, contact, shipping, and payout information, is accurate to the best of your knowledge.
- You will not submit counterfeit, pirated, materially unauthorized, or unlawfully reproduced material.
These representations are material to our decision to accept a shipment for inspection and to purchase an item.
3. Buyback Process, Quotes & Inspection
Preliminary quotes: A buyback quote is preliminary, not a final purchase price. The Site records a quoted amount at order submission, but physical inspection determines the actual condition, identity, quantity, authenticity, eligibility, and final payout treatment of each item.
Seven-day quote window: Buyback orders are created with a seven-day expiration window. The Site does not permit purchase of a new inbound shipping label for an expired order. Expiration does not override inspection requirements for an item already received.
Inspection adjustments: We may reduce an item's valuation or reject it when inspection shows that the item differs from the submitted information or does not satisfy the applicable buyback standards, including when quantity, ISBN/edition, authenticity, completeness, or condition differs from what was quoted.
If inspection results in a reduced valuation, the Site may mark the item as price-adjusted or action-required and present the actions then available for that item. A reduced valuation does not create a separate click-to-approve workflow unless the Site expressly presents one. Where a seller decision is required, the available decision may include requesting return or authorizing disposition. The amount ultimately recorded for payout after inspection is the final payout for an accepted item.
By submitting a buyback order, you expressly accept this inspection and quote-adjustment policy for that transaction.
4. Physical Custody & Transfer of Legal Title
Before delivery: You retain legal title to submitted items while they are in transit to us. The shipping-risk allocation in Section 8 applies separately from legal title.
During inspection: When a carrier delivers your package to our facility, Azarias obtains physical custody for receiving, authentication, grading, and inspection. Physical custody alone does not transfer legal title. You continue to own each item while it is pending inspection and until Azarias accepts that item for purchase.
Accepted items: Legal title to a genuine item transfers to Azarias when inspection is completed and Azarias records that item as accepted for payout in the transaction records. From that point, Azarias owns the accepted item and may possess, resell, transfer, recycle, or otherwise dispose of it, subject to applicable law.
Rejected genuine items: If a genuine item is rejected and not accepted for purchase, you retain title during the return holding period described in Section 7. If you timely complete the required return-shipping arrangement, title remains with you while the item is returned.
Authorized disposition: If you affirmatively choose to discard a rejected or action-required genuine item, you authorize Azarias to recycle or dispose of it and transfer to Azarias the ownership and disposition rights necessary to do so. If you fail to complete the required return-shipping arrangement within the disclosed 14-day holding period, you likewise authorize Azarias, after that period expires, to recycle or dispose of the item at its discretion, and the ownership and disposition rights necessary for that disposition transfer at that time.
Counterfeit or pirated material is governed by the separate policy in Section 6 and is not subject to the genuine-inventory return process.
5. Condition Standards
Azarias Books purchases resale-quality inventory. At checkout, you separately confirm that each submitted copy is in Good condition or better. Physical inspection, not the checkout attestation alone, determines actual condition.
A. Automatic Rejection Criteria
Items may be rejected at $0.00 value when they exhibit defects including:
- Water Damage: Moisture, wavy pages, swelling, mold, or water staining.
- Structural Damage: Broken spines, detached covers, or loose or missing pages.
- Excessive Marking: Highlights or writing beyond the permitted condition standard.
- Workbooks/Study Guides: Completed answers or other use that makes the item unsuitable for resale.
- Missing Components: Missing components that are integral to the quoted ISBN or edition.
- Odors: Strong smoke, mold, pet, or other material odors.
B. Restricted Editions
We do not purchase items that are ineligible under the quote or inspection rules, including International Editions unless specifically quoted under their own eligible ISBN, instructor or teacher editions that are not eligible, "Not For Resale" or complimentary copies, and counterfeit or pirated material.
6. Zero-Tolerance Counterfeit Policy
Counterfeit, pirated, and unlawfully reproduced books are prohibited. We may use authentication and inspection procedures to identify suspected counterfeit material.
If an item is determined to be counterfeit or pirated:
- No payment will be issued for that item.
- The item will not be returned through the genuine-inventory return process.
- To the extent permitted or required by law, the item may be retained, destroyed, recycled, or provided to a publisher, rights holder, carrier, law-enforcement agency, or other appropriate authority for investigation.
- Your account may be restricted or closed for policy, fraud-prevention, or legal reasons.
By submitting a buyback, you acknowledge that the genuine-item 14-day return procedure does not apply to material determined to be counterfeit or pirated.
7. Rejections, Returns & Disposition of Genuine Items
If a genuine item is rejected because of condition, edition, completeness, eligibility, or another non-counterfeit reason, Azarias does not pay the seller's return shipping.
The standard return process requires you to contact support and provide a prepaid return shipping label within 14 days after rejection or the applicable return notice. Where the Site instead offers a return-shipping payment link for a particular item, any amount shown through that workflow is for return shipping, not a separate Azarias return-processing fee.
Azarias does not charge a separate return-processing fee. You remain responsible for the cost of return shipping for rejected genuine inventory.
If you do not complete the required return-shipping arrangement within the 14-day holding period, you authorize Azarias to recycle or dispose of the item as described in Section 4. No buyback payment is due for a rejected item that is returned, recycled, or disposed of.
8. Shipping, Packing & Risk of Loss
Inbound shipping: Unless your checkout expressly confirms an available free-shipping allocation, you pay the USPS rate shown before an inbound label is issued. Your confirmed order page provides the label and tracking details after payment. Risk of loss remains with you until the carrier records the package as delivered to our facility. After delivery, the title rules in Section 4 govern while we hold the items for inspection.
Packing responsibility: You are responsible for packaging items securely. Damage caused by inadequate packing may affect inspection, eligibility, or payout.
Nothing in these Terms limits any non-waivable rights or carrier remedies available under applicable law.
9. Payment
Payment is issued only for items accepted after inspection. The quoted amount shown when an order is submitted is not a guarantee of payment.
The current buyback account workflow uses PayPal payout information. You are responsible for keeping the payout email and other transaction information accurate. Payout timing depends on completion of the downstream receiving, inspection, fraud-prevention, and payment workflow.
10. Service Availability, Disclaimers & Liability
To the extent permitted by law, the Site and valuation service are provided on an "as available" basis. We do not guarantee that every ISBN will remain eligible, that a quoted price will remain available beyond its stated order window, or that third-party shipping or payment services will be uninterrupted.
Azarias is responsible for obligations expressly stated in these Terms and for liabilities that cannot lawfully be excluded. To the extent permitted by law, Azarias is not liable for indirect, incidental, special, or consequential losses arising solely from interruption or unavailability of the Site or third-party services. This provision does not override the express shipping-risk, title, return, payment, or other transaction obligations stated in these Terms.
11. Buying Books from Azarias
These buyer terms apply when you purchase a physical book from Azarias Books. The product page identifies the copy offered and its described condition. Some copies may still be on their way to our preparation facility when listed. We will verify the copy's identity, completeness, and condition before shipment. A carrier's transit estimate begins after shipment; it does not include our handling time.
Shipping time: Before payment, the cart shows the latest date by which we reasonably expect to ship the books in that order, based on the information then available. Inbound copies may take longer to handle than copies already at our facility. We do not offer checkout when we cannot provide a supported shipping date. We will send your order to the delivery address confirmed at payment.
Changes before shipment: If an offered copy is unavailable, is a different edition or identity, or has a materially different condition than described, we may cancel the affected unshipped order. We will notify you and promptly refund the full amount paid for any order we cancel before shipping, including its shipping charge. We will not substitute a different copy or charge you more without your agreement.
Shipping delays: If we learn that we cannot ship by the stated date, we will notify you in time to make a meaningful choice. We will give you a supported revised shipping date, or explain why we cannot provide one, and offer the choice to agree to wait or cancel for a full and prompt refund. We will cancel and refund when required if you decline, do not consent when consent is required, or we cannot ship. You can request cancellation before shipment by contacting info@azariasbooks.com.
These terms do not limit any non-waivable consumer rights. The shipping date and copy details shown at checkout are part of the buyer transaction; later changes to these Terms do not silently change an order already placed.
12. Governing Law, Venue & General Contract Terms
Governing law: These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, except where applicable law requires otherwise.
Venue and jurisdiction: Subject to any non-waivable right to bring a claim elsewhere, disputes arising from these Terms or a buyback transaction may be brought in a state or federal court of competent jurisdiction located in New Jersey, and the parties consent to the jurisdiction of those courts.
Severability: If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Entire agreement: These Terms, together with transaction-specific information presented at checkout and any policies expressly incorporated into them, form the agreement governing the applicable transaction and supersede prior statements about that transaction to the extent they conflict.
Changes and versioning: We may revise these Terms prospectively. A future revision does not silently replace the Terms version already recorded for a submitted buyback order. A new buyback submission requires acceptance of the version presented for that transaction.
Notices and contact: Legal notices or questions concerning these Terms may be sent to legal@azariasbooks.com. Transaction and support communications may also be sent through the contact methods associated with your account.
